Customs Broker

Customs broker is any person who is bonafide holder of a valid Certificate of Registration/Professional Identification Card issued by the Professional Regulatory Board and PRC.

Board refers to the Professional Regulatory Board for Customs Brokers in the Philippines.

As to provided for in Customs Brokers Act of 2004, an examination is required to be undergone by all applicants seeking to be registered and licensed as professional customs broker. The exam is to be given by the Board at least once every year in such places and dates as the Commission may designate in accordance with PRC Modernization Act of 2000.

Applicants for customs broker board exam, shall at the time of filing his/her
application, establish to the satisfaction of the Board:
a. He/she is a citizen of the Philippines or of a foreign country qualified to take the examination as provided in the reciprocity provision of Republic Act No. 9280.
b. He/she is a holder of a Bachelor’s Degree in Customs Administration: Provided, That a holder of a master’s degree in Customs Administration shall be allowed to qualify within five (5) years from the effectivity of R.A. No. 9280.
c. He/she is of good moral character and must not have been convicted of any crime involving moral turpitude.

Scope of Customs Broker Board Examination

The examination shall include but not limited to:
1. Customs laws and implementing rules and regulations
2. Tariff laws and international trade agreements
3. Practical computation of customs duties, taxes and other charges
4. Documentations, professional ethics, customs procedures and practices
5. Warehousing and cargo handling operations

The Board may recluster, rearrange, modify, add or exclude any of these subjects as the need arises.

Based on Sec. 17 of Customs Brokers Act of 2004, an examinee must have obtained an average of at least seventy five percent (75%) in all subjects, with no rating below sixty percent (60%) in any subject to pass the examination.

Oath of Profession

All successful candidates for registration shall be required to take an oath of profession before any member of the Board or any government official authorized by PRC or any person authorized by law to administer oaths before entering the practice of customs broker in the Philippines.
